In the event of an accident abroad, if a Ukrainian driver is injured, he or she should contact the insurance company of the person responsible for the accident. Not every foreign insurance company has an extensive network of offices, but many of them accept documents by mail or electronically. Information on how to report an accident and the package of documents required for settlement is mostly available on the websites of the respective insurers.
The insurance indemnity is paid on the terms and conditions set out in the legislation on compulsory motor third party liability insurance in the country where the accident occurred.
If the person responsible for the accident does not have a liability insurance policy (this also happens abroad), it is possible to contact the Green Card Bureau of the country where the perpetrator's vehicle is registered to get advice on further actions.
Please note that MTIBU does not have the authority to settle accidents that occurred with cars with Ukrainian registration abroad!
It should be borne in mind that in each country, road users must comply with the requirements of national legislation and adhere to the established traffic rules of that country. At the same time, a great advantage of modern road traffic is the use in many member countries of the Green Card system of the Vienna Convention on Road Traffic (an international agreement to facilitate international traffic and improve road safety by introducing standard traffic rules).
Ukraine also ratified this international agreement in 1974. In general, the requirements of the Ukrainian traffic rules in terms of driver behaviour in the event of an accident on the territory of Ukraine are in line with the requirements of the legislation of other European countries.
Advice on the algorithm of actions in the event of an accident abroad:
- Call the police and, if necessary, other services and do not leave the scene of the accident until they arrive. If there are no injured or dead people and/or significant damage to the vehicles involved in the accident, it is possible to issue an agreed report of a road traffic accident - EAR.
- In most of the member countries of the Green Card system, the EAR form is unified, i.e. its structure, field names and columns are the same. Each policyholder can obtain the Ukrainian form of EAR when concluding a Green Card agreement with a Ukrainian insurer. The EAR form and instructions for filling it out are also available on the MTIBU website. EAR should be filled in in the language spoken by the party involved in the accident. In no case should you sign documents whose content you do not understand. If this is unavoidable, state in Ukrainian that you do not understand the content of the document and the language in which it is drawn up.
Important! EAR cannot be drawn up for an accident abroad.
- After taking safety measures for all road users, if technically possible, it is necessary to: photograph the accident scene, damage to all vehicles or other property, recording the coordinates of the accident scene (geolocation data), or make a video recording from the accident scene.
- Take down the details of the other parties to the accident: Driver's name, driver's licence details, contact telephone number, insurance company name and policy number; record information about witnesses and their contact details.
- Take photos, if technically possible, of all the documents that were drawn up at the scene of the accident (police report, EAR, etc.).
- If you believe that you are responsible for the accident, provide the other party with information about your Green Card international insurance contract.
We remind you that you can obtain information on the status of the Green Card agreement concluded in respect of vehicles with Ukrainian registration remotely on the MTIBU website - by entering the agreement number or the vehicle's state number.
- If you believe you are the victim of an accident, insist that the culprit provide a copy of their insurance policy (or information about it) and notify their insurer of the accident from the scene.
- If it is obvious from the situation that you are a victim, do not provide copies of your Green Card international insurance contract to anyone other than police officers to avoid becoming a victim of fraud.
Regardless of who you consider to be at fault for the accident, inform the insurance company with which you have concluded the Green Card international insurance agreement about the accident as soon as possible by any communication means agreed with the insurer.
